Illinois Supreme Court
People v. Tompkins
February 17, 2023466 Ill. Dec. 47
Summary
The court affirmed defendant’s conviction for unlawful use or possession of a weapon by a felon. It held that section 10-30 of the Law Enforcement Officer-Worn Body Camera Act required a jury instruction addressing intentional failure to activate a body camera, reasonable justification, and the effect on credibility, but defendant’s proposed instruction was legally incomplete because it omitted reasonable justification. The court also held that admitting footage showing a coarrestee’s marijuana was error but harmless in light of the immediate clarification and strong corroborating evidence.
