Summary

The court held that a nonexpert police officer could not testify to the scientific conversion factor used to convert serum alcohol concentration into a whole-blood equivalent, so the State failed to prove the whole-blood concentration element of count I. The error was harmless as to count II because the remaining evidence overwhelmingly established that defendant drove while under the influence of alcohol. The court also affirmed the appellate court's ruling that defendant's posttrial motion to substitute counsel should have been granted. No separate opinions were filed.
