Summary

The court held that the Emergency Telephone System Act provides the governing, limited immunity for claims alleging that a 911 dispatcher intentionally or recklessly refused to dispatch emergency services. Nevertheless, it affirmed dismissal because the decedent's decision to drive while intoxicated was, as a matter of law, the sole proximate cause of her injuries and death. The court therefore affirmed on a different ground from the lower courts.
