Illinois Supreme Court
People v. Leib
June 16, 20222022 IL 126645
Summary
The court held that a parish parking lot separated from a school by a public street constituted "real property comprising any school" under the applicable statute because it was used for school purposes and was part of a connected church-and-school campus. The court also held that the evidence, viewed in the light most favorable to the prosecution, permitted a rational fact finder to conclude beyond a reasonable doubt that defendant was aware of the substantial probability that the lot was school property. The court therefore affirmed defendant's conviction.
