Illinois Supreme Court
People v. Kastman
September 22, 2022463 Ill. Dec. 898
Summary
The Illinois Supreme Court held that a circuit court has authority under the Sexually Dangerous Persons Act to order the Department of Corrections Director to contribute to the treatment costs and living expenses of a sexually dangerous person on conditional release. Conditional release does not terminate the person's commitment, the Director's guardianship, or the statutory duties to keep the person safely and provide care and treatment designed to effect recovery. The court affirmed the appellate court's judgment and held that the circuit court may apportion expenses based on the person's ability to pay.
