Summary

The Illinois Supreme Court held that ordering a fitness evaluation did not itself establish a bona fide doubt about defendant's fitness or require a fitness hearing. Because neither defense counsel nor the trial court identified a bona fide doubt or requested a fitness hearing, the trial court committed no error, plain or otherwise, by proceeding to trial after receiving the evaluation report. The court reversed the appellate court and affirmed the circuit court's judgment.
