Summary

The Illinois Supreme Court reversed the appellate court and affirmed the circuit court’s judgment because the record did not show that the trial court found a bona fide doubt about defendant’s fitness or that any party requested a fitness hearing. Ordering a fitness evaluation alone did not require a later fitness hearing, and the trial court therefore committed no error in proceeding to trial. The court also held that the State’s argument concerning the absence of a bona fide doubt was reviewable because it was intertwined with the issue properly before the court.
