Illinois Supreme Court

In re Marriage of Mayfield

June 28, 20132013 IL 114655

Summary

The court held that a lump-sum workers’ compensation settlement is income for purposes of calculating child support and that the statutory guideline ordinarily applies to the entire settlement. Although a court may deviate from the guideline based on the settlement’s nonrecurring nature and the parties’ circumstances, Mayfield neither specifically requested a deviation nor presented sufficient evidence to support one. The appellate court’s judgment affirming the child-support award was therefore affirmed.
