Summary

The Idaho Supreme Court reversed the district court’s denial of a Rule 36 motion and remanded for correction of the judgment to reflect the oral pronouncement that the two murder sentences run consecutively and the other four sentences run concurrently. The Court held that the oral pronouncement controls over the written judgment and that Rule 36 is not the proper vehicle for such correction, directing use of Rule 35(a).
