Idaho Supreme Court

State v. Al Muthafar

June 13, 2024

Summary

The court held that hearsay testimony from a forensic nurse was improperly admitted at the preliminary hearing because the State did not establish that the victim's statements were made for medical diagnosis or treatment. Nevertheless, the error did not require dismissal or reversal because the defendant received a fair jury trial, where the victim testified and the properly admitted evidence was sufficient to support the convictions. The court also held that the fifteen-year sentence, including five years fixed, was not an abuse of discretion.
