Summary

The Idaho Supreme Court affirmed summary dismissal of Hooley's post-conviction petition. It held that the federal actual-innocence gateway does not apply to Idaho post-conviction proceedings, that Hooley's non-DNA actual-innocence claim was untimely and failed the newly discovered evidence standard, and that his Brady claim was filed unreasonably late after discovery of the alleged evidence. The court therefore concluded that neither claim warranted an evidentiary hearing.
