Summary
The Idaho Supreme Court held that the six-month period governing enforcement of a mechanic’s lien does not limit a claimant’s action against a lien-release bond after the lien has been released for all purposes. Because the bond statutes contain no specific limitations period, the two-year period for actions on bonds applies, and the district court erred by releasing the bond. The court reversed the district court’s judgment, awarded Pro Rentals attorney fees and costs on appeal, and left the extent of fees on remand for the district court.
