Summary

The court held that Georgia's constitutional standing doctrine does not permit a plaintiff to invoke Georgia courts by asserting only the rights of a nonparty under the federal doctrine of third-party standing. It overruled the prior state precedent adopting that federal doctrine and rejected the argument that applying Georgia's neutral standing rule to a federal claim violates the Supremacy Clause. The judgment was vacated and the case remanded for the lower courts to address, if still pursued, whether the plaintiff validly acquired the third party's claim by assignment.
