Supreme Court of Georgia

Fraser v. State

September 16, 2025

Summary

The court rejected Fraser's ineffective-assistance claims concerning counsel's failure to stipulate to his felon status and counsel's questioning about his juvenile history. Because Fraser testified, the prior felony was independently relevant for impeachment, and counsel's juvenile-history questioning was a reasonable strategic effort to elicit mitigating and sympathetic evidence. The court nevertheless vacated the aggravated-assault conviction and sentence for the abdominal shot because the evidence showed no deliberate interval separating it from the fatal shot, while affirming the judgment in all other respects.
