Summary

The court affirmed Evans’s convictions and sentences and affirmed Miller’s judgment except for the sentence on the aggravated-assault count involving Arrington. It held that direct evidence rendered the circumstantial-evidence statute inapplicable, that the ineffective-assistance claims failed for lack of deficient performance, prejudice, or preservation, and that the Arrington aggravated-assault count merged into the corresponding armed-robbery count. The court also upheld separate sentences for the two Gang Act violations because the governing statute treats them as separate offenses.
