Summary

The court held that Tripp knowingly, intelligently, and voluntarily waived his Miranda rights during the May 23 and June 2 custodial interviews, and that his conduct during the June 2 interview did not unambiguously invoke his right to remain silent. The court further held that statements Tripp made before 3:37 p.m. during the June 9 interview were admissible because they were spontaneous or made while counsel was present, but statements after 3:37 p.m. were inadmissible. The court therefore affirmed in part and reversed in part the trial court's suppression ruling.
