Supreme Court of Georgia

State v. Ledbetter (and Vice Versa)

March 5, 2024318 Ga. 457

Summary

The court affirmed both suppression orders. It held that the attorney-client privilege barred the State from using communications disclosed by Ledbetter’s former attorney and from identifying the attorney as the source of physical evidence, but did not suppress the physical evidence itself or investigative evidence derived from the disclosures so long as privileged communications and the attorney’s role were not revealed. The court also held that both cell-phone-record warrants were supported by probable cause and rejected Ledbetter’s remaining challenges to the warrants.
