Hostetler v. the State

Summary

The Court held that Hostetler's habeas petition challenging her misdemeanor DUI conviction was not moot after she completed her sentence because the conviction could subject her to an enhanced sentence for a future DUI conviction. The Court further held that a misdemeanor habeas petitioner may demonstrate this collateral consequence by identifying the applicable sentencing statute in written filings or during argument before the habeas court. Because Hostetler did so, the Court vacated the dismissal and remanded for further proceedings.
