The Court held that a completed misdemeanor DUI sentence does not moot a habeas petition when the conviction could subject the petitioner to an enhanced recidivist sentence for a later DUI conviction. It further held that a misdemeanor habeas petitioner may demonstrate that consequence by identifying the applicable sentencing statute in written filings or during argument before the habeas court. The Court vacated the dismissal and remanded for further proceedings.
