Supreme Court of Georgia
Eleby v. State
June 11, 2024319 Ga. 234
Summary
The Court affirmed the convictions and sentences except for the separate sentences for armed robbery and conspiracy to commit armed robbery, which it vacated because the former merged into felony murder and the latter had to merge with the completed offense. It held that the evidence was constitutionally sufficient, the identification challenges failed or were unpreserved, and the remaining evidentiary, prosecutorial, sentencing, and ineffective-assistance claims did not warrant relief. The Court also concluded that the aggravated-assault convictions did not merge because those offenses were completed before the armed robbery and involved different victims.
