Durden v. State

Summary

The court affirmed Durden’s convictions except for the armed-robbery conviction and sentence, which it vacated because armed robbery merged into the felony-murder conviction predicated on that offense. It held that any errors in permitting identification testimony and omitting an accomplice-corroboration instruction did not satisfy the outcome-affecting requirement of plain-error review, individually or cumulatively. The court also concluded that the evidence independently and mutually corroborated the accomplice testimony.
