Summary

The court held that it lacked equal-division jurisdiction because the Court of Appeals judges agreed that the summary-judgment order could not stand and disagreed only about the reason and whether the order should be vacated or reversed. Because the disagreement did not concern whether the appealed judgment should be set aside, the court returned the case to the Court of Appeals.
