Summary

The court held that a manufacturer’s duty to exercise reasonable care in selecting among alternative product designs extends to reasonably foreseeable risks even when the product is intentionally or tortiously misused by a third party. The Maynards adequately alleged that Snap could foresee that its Speed Filter might encourage dangerous speeding and cause collisions, so dismissal on the ground that Snap owed no duty was erroneous. The court reversed and remanded for the Court of Appeals to address the unresolved proximate-cause grounds for dismissal and judgment on the pleadings.
