Summary
The Court held that a child charged in juvenile court with a delinquent act based on an alleged violation of Georgia’s Criminal Code may assert insanity and delusional-compulsion defenses. Reading the Juvenile Code together with the Criminal Code, the Court concluded that conduct excused by either defense is not an act designated a crime and therefore is not a delinquent act. The Court vacated the order denying T.B.’s request for a forensic psychological evaluation and remanded for reconsideration consistent with its opinion.
