Summary
The court held that the evidence was legally sufficient under Georgia’s accomplice-corroboration statute because the jury could reasonably find that the key witness was not an accomplice, making corroboration unnecessary. However, the trial court erred by refusing to give a curative instruction after the prosecutor improperly asserted that his charging decision established that the witness was not an accomplice. Because the State failed to show that the error was harmless, the court reversed Caldwell’s convictions.
