McGarity v. State

Summary

The Supreme Court of Georgia affirmed most of McGarity’s murder convictions but reversed the simple battery and reckless conduct convictions because the trial court improperly admitted prior consistent statements that bolstered key witnesses. The Court also held that the limitation on cross‑examination of witnesses’ prior convictions was not preserved and that the forensic biologist’s refreshed recollection did not violate Brady/Giglio. The convictions were partially affirmed and partially reversed.
