Summary

The Court held that double jeopardy did not bar retrial because the evidence at Johnson’s first trial would have permitted a properly instructed jury to find that the principal witness was not an accomplice and that his testimony therefore required no corroboration. Applying the federal constitutional sufficiency standard, the Court also concluded that the evidence was legally sufficient to support the verdict. The Court affirmed the denial of Johnson’s plea in bar.
