Jackson v. Crickmar

Summary

The Supreme Court of Georgia held that merger claims may be raised for the first time in a habeas corpus proceeding and are not barred by failure to raise them earlier, and it affirmed that Jackson’s aggravated assault and aggravated battery convictions merge into his attempted murder conviction but rejected the merger of attempted armed robbery. Accordingly, the Court affirmed the habeas court in part, reversed it in part, and remanded with instructions to vacate the aggravated assault and battery convictions and sentences.
