Summary

The Court held that the evidence was legally sufficient to support Hinton's convictions because the jury was entitled to credit the eyewitness identification and corroborating evidence. It also held that the trial court correctly applied the thirteenth-juror standard and that the appellate review of the new-trial ruling was limited to evidentiary sufficiency. The Court nevertheless vacated Hinton's aggravated-assault conviction and concurrent sentence because that offense merged into the armed-robbery conviction.
