Sullivan v. State

Summary

The court affirmed Sullivan’s convictions, holding that the evidence was sufficient to prove the intent required for felony murder and aggravated assault and to support the remaining convictions. Although the trial court should have instructed the jury on accident, the omission was harmless because the evidence strongly showed intentional conduct and the jury was instructed that intent had to be proved beyond a reasonable doubt. The court also upheld the exclusion of evidence concerning Sullivan’s lack of mental illness and the admission of her son’s statement as an excited utterance.
