Price v. State

Summary

The court affirmed Price's malice-murder conviction and life-without-parole sentence. It held that his statement was voluntary despite the investigator's references to speaking with a judge, not seeing the light of day, and gunshot-residue evidence because the interview was noncustodial and the remarks did not create an impermissible hope of benefit or fear of injury. The court also held that the trial court was presumed to have exercised its discretion as the thirteenth juror and that Price failed to establish prejudice from counsel's alleged failure to present mitigation evidence.
