Supreme Court of Georgia

Cain v. the State.

August 5, 2019831 S.E.2d 788

Summary

The court upheld Cain’s convictions after rejecting his challenges to the sufficiency of the evidence, the voluntariness and admission of his custodial statement, and the denial of a mistrial based on alleged discovery violations. The court nevertheless vacated the aggravated-assault sentencing because the aggravated assault of Mobley merged into the malice-murder conviction and remanded for resentencing on the aggravated assault of Gregory only. There were no separate opinions.
