Summary
The court held that the evidence was sufficient to support Battle's convictions for malice murder and first-degree cruelty to children because the jury could find that she acted maliciously and was at least a party to the crimes. It rejected Battle's due-process challenge to the prosecutor's differing arguments at her trial and her claim that improper closing-argument statements required a mistrial because the trial court gave adequate corrective instructions. The court vacated the aggravated-assault conviction because that offense merged into the malice-murder conviction.
