Summary
The court affirmed Kennedy's convictions, holding that trial counsel was not constitutionally ineffective for failing to object to the prosecutor's closing argument about other-acts evidence. Although the argument could be viewed as referring to criminal propensity, it could also reasonably be understood in context as addressing Kennedy's intent to commit the charged crimes, so no reasonable attorney was required to object. The court also independently determined that the evidence was legally sufficient to support the convictions.
