Summary

The court affirmed Franklin's convictions and sentence after holding that a trial court may not pre-trial determine whether the evidence will factually support noticed capital aggravating circumstances or dismiss a death-penalty notice on that basis. It also rejected Franklin's challenges to death-qualified jury selection and to the racial composition of the grand jury pool, and independently found the evidence sufficient to support the murder convictions.
