Summary

The court held unconstitutional the provisions of HB 597 that allowed private organizations to appoint four members of the DeKalb County Board of Ethics. Because the Board exercises governmental powers, the constitutional requirement that public officers and public affairs remain accountable to the people prohibits delegating appointment authority to private entities. The court therefore affirmed the trial court’s grant of quo warranto as to the four challenged appointments.
