The court affirmed suppression of Clark’s custodial police-station statements because the detective’s affirmative response to Clark’s request to speak “off the record” created a false assurance that undermined his understanding of his right against self-incrimination. The State therefore failed to prove by a preponderance of the evidence that the statements were voluntary, despite the earlier administration of Miranda warnings. All Justices concurred.
