Summary

The court affirmed the contempt finding because the evidence supported that Husband willfully failed to execute the required quitclaim deed and otherwise failed to cooperate with the sale of the rental property. It held, however, that the trial court improperly modified the divorce decree by requiring Husband to pay repair costs and share ongoing HELOC payments and taxes that the decree assigned to Wife after March 1, 2009. The court vacated the attorney-fee award because the record did not show whether it included fees attributable to the remedies that were reversed, and remanded for reconsideration. Justice Grant, joined by Justice Hunstein, concurred in part and dissented in part, arguing that the repair remedy and attorney-fee award should have been affirmed.
