Supreme Court of Georgia
Edokpolor v. Grady Memorial Hospital Corporation
December 11, 2017
Summary
The court held that a summary judgment is not a final judgment when the trial court has expressly reserved the amount of service-of-process expenses sought during the pending action. Because the case remained pending until that amount was determined, the plaintiffs were not required to appeal within 30 days of the summary judgment. The court reversed dismissal of the appeal and remanded for consideration of the merits of the summary-judgment challenge.
