Supreme Court of Georgia

Dublin v. State

September 13, 2017

Summary

The court affirmed Dublin’s convictions after rejecting his ineffective-assistance, hearsay, mistrial, and sufficiency challenges. It held that the challenged hearsay was admissible under the co-conspirator exception, that any failure to object to the detective’s testimony did not prejudice Dublin, and that the curative instruction adequately addressed the witness’s reference to prior bad acts. The court nevertheless vacated the judgment in part because aggravated assault with intent to rob was improperly merged into felony murder and remanded for sentencing on that count.
