Summary

The Supreme Court of Florida approved most of the referee’s factual findings and findings of misconduct in two consolidated disciplinary proceedings, disapproving only the finding that Strems was responsible for one subordinate’s failure to communicate a settlement counteroffer. The Court additionally found that Strems violated duties concerning client objectives, excessive fees, and conflicts of interest in negotiating a settlement for an elderly client. Considering the cumulative misconduct, including firm mismanagement, repeated procedural violations, false affidavits, and self-interested fee conduct, the Court disbarred Strems and imposed costs.
