The Court held that the Workers’ Compensation Law’s grant of exclusive jurisdiction to the Department of Financial Services over matters concerning reimbursement does not deprive circuit courts of jurisdiction over an injured worker’s claims under the Florida Consumer Collection Practices Act arising from prohibited direct billing. The Court interpreted “reimbursement” according to its ordinary meaning and its consistent use in the Workers’ Compensation Law as payments from carriers to providers, distinct from payments sought directly from injured workers. The Court answered the certified question in the negative and approved the result reached by the Second District.
