Supreme Court of Florida
In Re: Amendments to the Florida Rule of Appellate Procedure 9.141
May 19, 2022
Summary
The court adopted a new requirement for petitions seeking belated discretionary review: the petitioner must identify the basis for discretionary-review jurisdiction and attach the decision under review. The court also amended the existing rule governing circumstances interfering with a timely filing by deleting a limiting phrase, permitting a case-by-case assessment of counsel-related neglect or mistake, while declining the Committee’s proposed consolidation amendments. The amendments take effect July 1, 2022, at 12:01 a.m.
