Supreme Court of Florida

State of Florida v. Ridge Gabriel

April 8, 2021314 So. 3d 1243

Summary

The court held that the lowest permissible sentence under section 921.0024(2) is an individual minimum sentence for each offense when multiple convictions are sentenced on one scoresheet. If the lowest permissible sentence exceeds an offense's individual statutory maximum, the lowest permissible sentence becomes both the minimum and maximum sentence for that offense. The court therefore quashed the Fifth District's decision and approved the conflicting decision to the extent consistent with its reasoning.
