Supreme Court of Florida

Florida Department of Health v. Florigrown, LLC

June 10, 2021

Summary

The court quashed the First District's decision upholding portions of a temporary injunction against Florida's medical-marijuana licensing scheme. It held that Florigrown failed to show a substantial likelihood of success on any of its three constitutional challenges: the vertical-integration requirement, statutory license caps, and alleged special laws granting privileges to private corporations. Because failure to establish any one injunction element requires denial of the injunction, the court did not address the remaining elements.
