Summary
The court struck the proposed adult-use marijuana amendment because its ballot summary affirmatively misled voters by stating without qualification that the amendment would permit marijuana possession, use, purchase, display, and transport. Although the amendment would remove Florida-law penalties, federal law would continue to criminalize the conduct, and the summary omitted the amendment's limitation to Florida law. The court therefore did not reach the single-subject issue or challenges concerning the later-enacted review statute.
