Supreme Court of Florida

Michael Barnett v. State of Florida, Department of Financial Services

September 24, 2020

Summary

The Court held that all injury and wrongful-death claims arising from the mass shooting constituted claims arising from the same incident or occurrence under Florida’s limited waiver of sovereign immunity. Because the shooting was one overall injury-causing event, the State’s aggregate liability was capped at $200,000 absent a legislative claims bill. The Court approved the Fourth District’s decision.
