Summary

The court quashed the Fifth District's decision and upheld Orange County's charter amendment establishing nonpartisan elections and term limits for county constitutional officers, except for the provision requiring those elections to occur during the primary election. It held that the Florida Election Code did not expressly preempt the county's authority to require candidates to appear on the general-election ballot without party affiliation, but that the primary-election requirement directly conflicted with state law and was severable. The remaining ordinance could therefore stand after removal of the conflicting language.
