Summary

The Florida Supreme Court held that an indigent defendant represented by private pro bono counsel is entitled to file ex parte, sealed motions for the appointment and funding of experts, mitigation specialists, and investigators, with notice to the Justice Administrative Commission and the State Attorney, and to have any hearing on such motions conducted ex parte before only the defendant and the Commission. Accordingly, the Court quashed the First District Court of Appeal’s decision and remanded the case for resentencing consistent with Miller v. Alabama.
