Summary

The court affirmed Oliver’s two first-degree murder convictions and death sentences. It held that the shotgun evidence was relevant to show how Oliver obtained and attempted to dispose of the murder weapon, that the prosecutor’s brief reference to lack of remorse did not warrant a mistrial, and that competent, substantial evidence supported the cold, calculated, and premeditated aggravator for Richardson’s murder. The court also held that any constitutional error in the penalty phase was harmless beyond a reasonable doubt because the jury unanimously recommended death. Justice Quince, concurring in part and dissenting in part, would have found error in admitting the shotgun evidence, rejected the Richardson aggravator, and required a new penalty phase.
